Results of "Rīgas satiksme" official investigation into purchase of detergents
In response to the information on the purchase of chemical detergents for cleaning and processing of public transport vehicles, which was broadcast on TV, "Rīgas satiksme" has carried out an official investigation. Having analyzed the information on the evaluation of the purchase, delivery and use of chemical detergents, which was at the disposal of "Rīgas satiksme", the official investigation commission made the following conclusions:
1. Given the fact that the detergents delivered were used in June 2014, the official investigation commission cannot verify the conformity of these detergents.
2. The documents being at the disposal of "Rīgas satiksme" and the written and verbal information provided by the company’s employees confirm that the goods were delivered and used for their specific purposes, and that the goods delivered had a specific smell, which did not change in different periods of time, and different detergents had different colours and consistence (transparent, white, yellowish, powder-like) which did not change in different periods of time either. Individual means of protection were required to work with these detergents.
3. Having assessed the information being at the disposal of "Rīgas satiksme", the Commission:
- does not ascertain a conflict of interests of V.Stunžāns in relation with the 2010 deals with SIA „RS Baltic” on the processing of vehicle surfaces with Nanopool Baltic surface coverage products, because during these experiments V.Stunžāns was not employed by "Rīgas satiksme" yet;
- does not ascertain a conflict of interests in relation with "Rīgas satiksme" contract No.LIG/2012/219 with SIA „RS BALTIC”, because V.Stunžāns was not the person responsible for the fulfilment of contract No. LIG/2012/219 on the part of "Rīgas satiksme"
- does not ascertain a conflict of interests of V.Stunžāns in relation with the conclusion and fulfilment of SIA „MJ PARTNERI” contract No. LIG-IEP/2013/5, because on December 18, 2012 the procurement request was submitted by Deputy Technical Director in charge of technical support matters. SIA „RS BALTIC” submitted its offer, which was signed by board member Evija Ratniece, yet did not win the tender. The authorised person of "Rīgas satiksme" in the contract of "Rīgas satiksme" with SIA „MJ PARTNERI” was Vjačeslavs Stunžāns, deputy head of the Technical Control Unit, yet the information being at the Commission’s disposal and the explanations of V.Stunžāns testify that V.Stunžāns had no relation with SIA „MJ PARTNERI” – he was not an employee or executive of this company;
- does not ascertain a conflict of interests in relation with the Procurement request of April 7, 2014, submitted by Vjačeslavs Stunžāns, deputy head of the Technical Control Unit, and the fulfilment of "Rīgas satiksme" contract No. LIG-IEP/2014/11 with SIA „VIALEKS”, where Vjačeslavs Stunžāns, deputy head of the Technical Control Unit, was the person authorised by "Rīgas satiksme", because at the time V.Stunžāns was no longer an executive of SIA „RS BALTIC”.
4. The process of cleaning public transport vehicles was ensured in conformity with the requirements set by "Rīgas satiksme", and there was observed a decrease in the number of motivated complaints about the cleanness of vehicles.
5. The deals were closed in conformity with the regulatory enactments which were in force at the time, pursuant to the procedure established by Section 13 of the Law on Procurements of Utility Service Providers and by Cabinet Regulations No. 840 „Regulations on the Limits of Contract Prices for Procurements of Utility Service Providers” of September 7, 2010.
Given the fact that the State Revenue Service will investigate this case in "Rīgas satiksme", "Rīgas satiksme" has decided to suspend Vjačeslavs Stunžāns, deputy head of the Technical Control Unit, from fulfilling his official duties for the period of further investigation.
